      3. 20.3.3 registering a database and complying with the reporting and security obligations, to the extent they apply to it under the Protection of Privacy Law, 5741-1981 and its regulations, including the Protection of Privacy Regulations (Data Security), 5777-2017;
      4. 20.3.4 complying with labor law, including the duty to notify employees about monitoring, tracking and attendance recording;
      5. 20.3.5 responding to requests for access, correction and deletion from the people whose information was entered. The business will forward to the Organization any such request that reaches it.
    4. 20.4 The user undertakes to enter only information needed for a legitimate and defined purpose, to refrain from entering sensitive information (such as medical or biometric information), and to refrain from photographing or documenting a person against his wishes or in circumstances in which he has a reasonable expectation of privacy.
    5. 20.5 The system may not be used for covert tracking of people or for any act contrary to law or to human rights.
    6. 20.6 Attendance, working-hours and payroll data, to the extent managed in the system, are a management aid only. They are not a substitute for the recording of working hours, for payslips, for reporting to the authorities or for any other duty of the employer under law, and responsibility for their accuracy and for compliance with those duties lies with the employer and the Organization.
  21. 21. Location data
    1. 21.1 Certain features of the system, such as reporting attendance from a mobile device, marking a task location on a map, and retrieving a weather forecast for the work diary, request access to the device's location. Access is subject to your approval in the device or browser, and you may refuse or revoke it at any time in the device settings. Refusal may prevent use of the feature, for example where the system administrator has determined that attendance reporting requires location.
    2. 21.2 In an attendance report, the coordinates captured are stored as part of the report and may be checked against the boundaries of the construction site, according to the settings defined by the system administrator. The system administrator determines whether attendance reporting requires location, and is responsible for informing workers and contractors of this and for obtaining their consent where required by law.
    3. 21.3 To retrieve a weather forecast, the location coordinates are transferred to an external weather service provider.
    4. 21.4 Location data is captured from the device and is not necessarily accurate. It should not be regarded as conclusive evidence of location, and the business is not responsible for any inaccuracy or distortion of location.
  22. 22. Artificial intelligence services and the virtual assistant "Easy"
    1. 22.1 The system includes, or may from time to time include, features based on artificial intelligence (hereinafter: "AI"), including transcription of voice recordings into text or reports, editing and drafting of reports (including WhatsApp reports), recognition of data from documents such as delivery notes, generation of insights from schedule data, and the virtual assistant "Easy" which answers questions based on the Knowledge Center.
    2. 22.2 To operate these features, content that the user enters or uploads (text, a recording, an image or a document) is transferred to an external AI provider (as of the date of this update, OpenAI) for processing and for returning a result. The business endeavors to transfer only the content required for the requested action.
    3. 22.3 AI outputs are generated automatically and may be wrong, incomplete, misleading or out of date. They are not engineering, safety, legal, accounting or other professional advice. The user is responsible for checking every output before relying on it or passing it on, and any decision based on it is his sole responsibility.
    4. 22.4 Sensitive information, or information that the user is not permitted to transfer to a third party, must not be entered into the AI features.
    5. 22.5 "Easy" is a virtual assistant and not a person. Its answers are based on the content of the Knowledge Center, may be partial or out of date, do not constitute an offer, undertaking or promise by the business, and are not a substitute for contacting support. In a conversation with Easy:
      1. 22.5.1 anyone who chooses to start a conversation is asked to provide a name and a means of contact (telephone or e-mail) and to approve the terms of use and being contacted. The details are kept by the business and used for replying and follow-up contact;
      2. 22.5.2 the content of the questions and answers is saved and may be used to improve the service and to reply, and a summary of the conversation may be e-mailed to the business staff;
      3. 22.5.3 the user's name and contact details are not passed to the AI provider. Do not write sensitive personal details, passwords or credit card numbers in the conversation;
      4. 22.5.4 to prevent abuse, protective measures are used, including automated human verification (reCAPTCHA), request rate limits and capturing the IP address.
    6. 22.6 The business may limit, suspend or discontinue AI features at any time, including by means of daily usage quotas.
    7. 22.7 The AI features may not be used to generate unlawful, misleading or offensive content, to circumvent the system's limits, or to attempt to expose the internal instructions of the virtual assistant.
  23. 23. Messages and notifications
    1. 23.1 The system sends system and service messages, such as verification codes, invitations to join, task reminders, reports and updates, by SMS, WhatsApp, e-mail and Push notifications, among other things through external service providers such as Twilio. These messages are part of the service.
    2. 23.2 A user who configures the sending of a message to a third party (such as a worker, contractor, resident or visitor), or sends one through the system, declares that he is entitled to send it, that the number or address is correct, and that he has obtained the recipient's consent to the extent required under Section 30A of the Communications (Telecommunications and Broadcasting) Law, 5742-1982 and under the rules of WhatsApp and other messaging platforms. A message of an advertising nature will include an unsubscribe option, and the recipient may request removal at any time.
    3. 23.3 Delivery of messages depends on third parties such as mobile operators, WhatsApp and e-mail providers. The business does not guarantee that a message will arrive or when, and sending is not proof of receipt.
    4. 23.4 The user is responsible for the correctness of the telephone numbers and e-mail addresses he entered, and for his own charges with his communications provider.
  24. 24. Public forms, QR codes, digital signatures and the residents' portal
    1. 24.1 The system allows creating links and QR codes to public forms that do not require login (such as registration of visitors or workers, reporting a defect and ordering a change), as well as a portal for residents and buyers. The Organization is responsible for distributing the links only to the intended parties and for displaying next to the form a notice about the collection of information.
    2. 24.2 The business cannot verify the identity of a person who fills in a public form, and is not responsible for false details or for details entered by an unauthorized person, including after the link was passed on to others.
    3. 24.3 Signatures made in the system, such as signing plans, change orders and visitor forms, are ordinary electronic signatures unless expressly stated otherwise. They are not, in themselves, a "secure electronic signature" or a "certified electronic signature" under the Electronic Signature Law, 5761-2001, and their evidentiary weight will be determined according to the circumstances. The Organization is responsible for checking whether its legal affairs require a signature in another manner.
    4. 24.4 The business is not a party to the relationship between the Organization and the residents and buyers, and is not responsible for handling their inquiries, for the sale undertakings, for warranties or for repair dates. The content and data displayed in the portal are the responsibility of the Organization.
  25. 25. Professional modules
    1. 25.1 The quality management tools (QMS), construction quality control, checklists, defects and handover management, budget and commitments management, schedules and work diaries are management and documentation aids only.
    2. 25.2 Templates, procedures, questionnaires and forms in the system, including those that refer to standards (such as ISO), are provided as examples only. They are no promise of compliance with a standard, of obtaining certification, or of compliance with regulations, a permit or the requirements of an authority, and they are not a substitute for review by an engineer, supervisor, safety officer or qualified auditor.
    3. 25.3 Financial data, such as budget, commitments and accounts, is entered by the user. The system's calculations are intended for internal management only, are not accounting or tax advice, and are not a substitute for an accounting system.
    4. 25.4 The user is responsible for checking reports and documents produced in the system (such as PDF files) before passing them to a third party or an authority.
  26. 26. Offline mode and local storage
    1. 26.1 The system, including as a web application, allows partial work without a network connection. In this mode data and content are saved temporarily in the local storage of the browser or device, and synchronized with the server when the connection is restored.
    2. 26.2 Responsibility for the security of the device, including locking it and preventing access by others, lies with the user. Data that has not been synchronized should not be left on a shared device or on a device that may be lost.
    3. 26.3 Data that has not been synchronized may be lost, for example by clearing browser data, replacing the device or a synchronization conflict. The user is responsible for making sure the data was synchronized, and the business is not responsible for loss or for failure to synchronize.
  27. 27. Retention, backup, export and deletion of data
    1. 27.1 The system is not a dedicated backup or archive service. The user and the Organization are responsible for exporting and keeping copies of data and files that are important to them, particularly before the end of the period of use.
    2. 27.2 The business may make backups for operational and recovery purposes, but does not undertake to restore data. Deleted data may remain in backups for a limited period.
    3. 27.3 When the permission to use ends, the data will be deleted in accordance with Section 6. Without derogating from this, the business may retain information that is required by law or for defense in legal proceedings, fraud prevention, collection and accounting.
  28. 28. Information security and security incidents
    1. 28.1 A user who becomes aware of, or suspects, unauthorized access to his account or to information in the system shall notify the business immediately.
    2. 28.2 In a security incident affecting information for which the Organization is responsible as database owner, the business will notify the Organization without undue delay and will assist it in accordance with the law. The decision whether to report to the Privacy Protection Authority and to the data subjects rests with the Organization, to the extent required by law.
    3. 28.3 Penetration tests, security scans or load tests may not be performed on the system without the prior written approval of the business. Anyone who finds a security vulnerability is asked to report it to the business and not to exploit it.
  29. 29. Sub-processors and third-party services
    1. 29.1 The system relies on external providers, including hosting and server providers, e-mail, SMS and WhatsApp messaging (such as Twilio), artificial intelligence (such as OpenAI), Google services (such as Analytics, reCAPTCHA and maps), and map and weather forecast services. Information is transferred to them to the extent required to provide the service, as detailed in the privacy policy.
    2. 29.2 The providers' own terms of use also apply to the use of their services. A change or discontinuation of a service by a provider may impair the system's services, as stated in Section 18.4.
  30. 30. Payment, taxes and pricing changes
    1. 30.1 Prices are as displayed in the purchase process. Value added tax will be added or included according to what is stated at the time of purchase and as required by law.
    2. 30.2 The business may suspend or restrict access to the system, in whole or in part, for as long as payments that have fallen due have not been paid.
    3. 30.3 Trial periods, benefits and certain features are granted at the business's discretion and may be changed or discontinued. At the end of a trial period, if no permission to use has been purchased, access may be blocked and the data deleted in accordance with Section 27.
    4. 30.4 The prices of the permission to use for new periods and for renewal may change. A price change will not apply to a period that has been paid for.
  31. 31. Privacy Policy
    1. 31.1 The current Privacy Policy as published by the business in the system (hereinafter: "Privacy Policy") is an integral part of these terms of use.
  32. 32. Law and jurisdiction
    1. 32.1 Israeli law will apply to this agreement only. The courts in the Tel Aviv district will have unique and exclusive jurisdiction over any conflict or controversy that may arise between the parties to this agreement.
  33. 33. Miscellaneous
    1. 33.1 These terms of use represent the full agreement regarding the system's services and any changes to them will only be possible with a written agreement with the business.
    2. 33.2 If it is determined that any provision in the Terms of Use is unenforceable, then this provision will be redrafted, but only to the extent necessary to make it an enforceable provision.
    3. 33.3 The business may, at any time, change the terms of use, all of them, by publishing them in the system. It is agreed that your continued use of the system, after a change in the terms of use has been brought to your attention, will constitute your consent to said change.
    4. 33.4 Expiry of this agreement, the provisions of Sections 14 to 18, 20 to 22, 27 and 31 to 33 of the terms of use will continue to apply after the termination of this agreement, for any reason.
    5. 33.5 The user may not transfer and/or assign his rights to another.
    6. 33.6 The business may transfer and/or assign part and/or all of its rights and/or obligations to any third party at its sole discretion.
    7. 33.7 In the event of a discrepancy between versions of these terms of use in different languages, the Hebrew version shall prevail.
    8. 33.8 The system's records, including activity logs, timestamps and documentation of actions, shall constitute prima facie evidence of their content, including as to actions performed in the account and content uploaded to it.
    9. 33.9 The business may notify the user of updates by e-mail, text message, a message in the system or a publication on the website, and the notice shall be deemed delivered at the time it is sent or published.
    10. 33.10 Failure by the business to exercise a right or remedy shall not be deemed a waiver of it. Nothing in these terms of use creates an employment, partnership or agency relationship between the parties.
  34. 34. Contact details with the business
    1. Email: info@asmade.biz
    2. Telephone: 051-5134406
    3. These terms of use are valid as of: 16/10/2026
